By using our services, you agree to the terms and conditions described in this document. Please read carefully before using the platform.

Terms of Service (“Terms”) govern your use of Therafy and the software, content and services (collectively, “Services”) offered through: our website www.therafycare.com and its subdomains (the “Site”) and our virtual reality application provided through the Meta Quest store.

The terms “Therafy” or “we” refer to EXPLORER TECNOLOGIA LTDA, a software company that designed and developed Therafy, based in Campo Grande-MS, Brazil. CNPJ 34.259.701/0001-61.  

1. Acceptance of Terms

This Terms of Use ("Terms") governs the use of the services offered by Therafy. By accessing or using the platform, you agree to comply with these Terms. If you do not agree with any part of these Terms, do not use our services.

2. Services Offered

Therafy offers an educational platform in virtual reality that aims to help users develop social skills, autonomy, motor coordination, emotional regulation, literacy, among other important skills.

4. Subscription and Payment 

Therafy follows the Meta Horizon Store subscription and payment policy.

Therafy can change the subscription price without prior notice.

If the user cancel the subscription, Therafy can cancel user access to the platform.

5. Refund Policy

Therafy follows the Meta Horizon Store refund policy.

‍6. Use of the Platform

• Access: The user is responsible for ensuring that their equipment (virtual reality headset, access devices) is compatible with the Therafy platform.
• Use License: Therafy grants the user a limited, non-exclusive, non-transferable and revocable license to access and use the platform according to the chosen subscription plan.
• Cancellation: Therafy may cancel the plan at any time for any user registered on the platform without prior notification.
• Limitations: The use of the platform is restricted to the number of users permitted by the contracted plan. Sharing accounts to exceed this limit is prohibited and may result in subscription suspension or cancellation.

7. User Responsibilities

• True Information: The user undertakes to provide truthful and complete information during the subscription process and to keep this information up to date.
• Security: The user must keep their access credentials secure and not share them with third parties. Therafy is not responsible for unauthorized access resulting from security breaches attributable to the user.
• Misuse: The user undertakes not to use the platform for illegal purposes or that violate the rights of third parties, including, but not limited to, intellectual property and privacy rights.

8. Intellectual Property

• Therafy Rights: All intellectual property and brand rights relating to the platform, including, but not limited to, software, codes, design, texts, graphics, logos and brands, are the exclusive property of Therafy.
• Restricted Use: The user is not authorized to reproduce, modify, distribute, or create derivative works of any material on the platform without prior written authorization from Therafy.

9. Limitation of Liability

Therafy is not responsible for any direct, indirect, incidental, special, consequential or punitive damages arising from the use of the platform, such as accidents during use, complaints, misuse, among others. In any case, Therafy's liability will be limited to the value of the subscription paid by the user in the month prior to the event that gave rise to the complaint. 

10. Medical Disclaimer 

Therafy is a provider of software and content designed to improve daily living skills for people with autism and others. However, we are not a healthcare or medical device provider, nor should our Services be considered medical care, mental health services or other professional services. Only your doctor or other healthcare professionals can do this. Although there is evidence from third-party research that certain techniques implemented at Therafy can assist in the developmental process of people with disabilities, Therafy makes no claims, representations or warranties that the Services provide a therapeutic benefit. 

11. Privacy and Data Protection (state where the policy is)

Therafy collects, processes and stores personal data in accordance with our Privacy Policy and in accordance with the General Data Protection Law (LGPD). By using the platform, you consent to the collection and use of your data as described in the Privacy Policy.

12. Termination

Therafy may terminate or suspend the user's access to the platform in case of violation of these Terms, without the right to a refund. 

Therafy may suspend the use of any subscriber's platform by canceling the subscription and interrupting services without the need for prior notice.

13. Changes to the Terms of Use

Therafy reserves the right to modify these Terms at any time. Any changes will be notified to users. Continued use of the platform after the changes come into effect will constitute acceptance of them.

14. Service changes

Therafy reserves the right to make changes to the services available through platform updates and other means, without the need to notify users in advance.

15. Privacy policy

By using the Therafy platform, the user grants their consent to therafy's privacy policy and to the collection and use of user data in accordance with legislation.

16. General Provisions

• Applicable Legislation: This Term will be governed and interpreted in accordance with Brazilian laws.
• Forum: The court of the district of Campo Grande - MS, Brazil is elected as the only one competent to resolve any issues arising from this Agreement, the parties renouncing any other, however privileged it may be.
